Purchasing, subscribing to, or utilizing the Support constitutes your acceptance of these Terms, including the applicable Support terms, available at: lunatio.com/support-terms.
All purchases of Product licenses and Support services are final and non-refundable. We may, at our sole discretion, consider refund requests, provided that the Product or license has not been downloaded, installed, or activated, and the Support services have not been accessed, used, or otherwise engaged with.
All intellectual property rights in and to the Product and Support, including all source code, design, graphics, documentation, and trademarks, are and shall remain the sole property of Lunatio or its licensors. No ownership interest or title is transferred by virtue of this license agreement.
We may terminate or suspend your access to the Product and Support at our sole discretion, with or without notice, if you breach these Terms, or engage in conduct deemed harmful, unlawful, or abusive. In exceptional circumstances, we may also terminate your Product and Support access for any reason, including business or legal considerations. Upon termination, you must immediately cease all use of the Product and Support, and delete all copies in your possession.
THE PRODUCT AND SUPPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNATIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE PRODUCT OR SUPPORT.
You agree to indemnify, defend, and hold harmless Lunatio and its affiliates from any claims, losses, damages, liabilities, or expenses (including legal fees) arising out of your use of the Product or Support, violation of these Terms, or infringement of any third-party rights.
We may update these Terms at any time. Material changes will be posted on our website. Your continued use of the Product and Support after such changes constitutes your agreement to the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of Romania. You agree to submit to the exclusive jurisdiction of the courts located in Romania for the resolution of any legal matters arising from these Terms.
